Terms of Use — Excelcia

1. Acceptance. By downloading or using Excelcia (“the App”), you agree to these Terms. If you don’t agree, don’t use
   the App.
2. License. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own
   non-commercial purposes, subject to these Terms and the applicable app store’s terms.
3. Health & fitness disclaimer. Excelcia provides fitness tracking, workout guidance, calorie estimates, and related
   content for informational purposes only. It is not medical advice. Consult a qualified physician before starting any
   exercise or nutrition program. You use the App and perform any exercises at your own risk. Calorie and nutrition
   figures (including AI photo estimates) are approximate and may be inaccurate. We are not liable for any injury, health
   issue, or loss arising from your use of the App.
4. Accounts. You are responsible for your account and for keeping your credentials secure. You must provide accurate
   information and be at least 13 years old (or the minimum age required in your country).
5. Subscriptions & billing. Excelcia Premium is an auto-renewable subscription. Payment is charged to your Apple ID or
   Google account at confirmation of purchase. It renews automatically for the same period and price unless cancelled at
   least 24 hours before the end of the current period. Manage or cancel anytime in your App Store or Google Play
   account settings; deleting the App does not cancel a subscription. Prices are shown in the App and may vary by region.
   Refunds are handled by Apple/Google according to their policies.
6. Acceptable use. Don’t misuse the App, reverse-engineer it, attempt to breach its security, or use it unlawfully. We
   may suspend or terminate accounts that violate these Terms.
7. User content & data. Some data is stored only on your device and is lost if you uninstall the App. You can delete
   your account and associated cloud data in-app (Settings → Delete Account).
8. Intellectual property. The App, its content, logo, and design are owned by David Fischer and protected by
   law. You may not copy or redistribute them.
9. Disclaimers & limitation of liability. The App is provided “as is” without warranties of any kind. To the maximum
   extent permitted by law, we are not liable for indirect or consequential damages. Nothing in these Terms limits
   liability that cannot be limited under applicable law (including mandatory EU consumer rights).
10. Changes. We may update these Terms from time to time; continued use of the App after changes take effect
    constitutes acceptance.
11. Governing law. These Terms are governed by the laws of Slovenia / the European Union, without prejudice to
    mandatory consumer-protection rights in your country of residence.
